Graspr Privacy Policy

At Graspr, we take your privacy seriously. This Privacy Policy applies to all of the products, services and website, located at the URL: http://www.graspr.com/html/privacy.php (the “Site”) offered by Graspr Inc. or its subsidiaries or affiliated companies.
Information we collect:
We offer a number of services that do not require you to register for an account or provide any personal information to us, for instance, you can watch videos on Graspr without having a Graspr account.  To use certain other services on Graspr, however, for example, uploading videos, posting comments or watching restricted videos, we require you to have a Graspr account. In order to provide a full range of services, we may collect the following types of information:

  • Information you provide when registering for a Graspr account or completing a profile - When you sign up for a Graspr account or other Graspr service or promotion that requires registration, we ask you for personal information such as your email address, username and account password. We may combine the information you submit when registering for your account with information from your use of other Graspr services or third parties in order to provide you with a better experience and to improve the quality of our services. For certain services, we may give you the opportunity to opt out of combining such information. In addition, if you complete a profile on the Site, we may also collect personal information such as your first and last name, state of residence, hobbies, preferences and any other contact information that you voluntarily transmit with your communication to us.
  • Graspr cookies and web beacons - When you visit the Site, we send one or more cookies - a small file containing a string of characters - to your computer that uniquely identifies your browser. We use cookies to improve the quality of our service by storing user preferences and tracking user trends. Most browsers are initially set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent. However, some Graspr features and services may not function properly if your cookies are disabled. We may record information about your usage, such as when you use Graspr services, channels, groups, and favorites you subscribe to, the contacts you communicate with, and the frequency and size of data transfers, as well as information you display or click on in Graspr (including UI elements, settings, and other information). If you are logged in, we may associate that information with your account. We may use clear GIFs (a.k.a. "Web Beacons") in HTML-based emails sent to our users to track which emails are opened by recipients.
  • Log information - When you use Graspr services, our servers automatically record information that your browser sends whenever you visit a website. These server logs may include information such as your web request, Internet Protocol address, browser type, browser language, the date and time of your request and one or more cookies that may uniquely identify your browser.
  • User communications - When you send email or other communication to Graspr, we may retain those communications in order to process your inquiries, respond to your requests and improve our services.
  • Affiliated sites - We offer some of our services in connection with, and/or link to, other web sites. Personal information that you provide to those sites may be sent to Graspr in order to deliver the service. We process such information in accordance with this Privacy Policy. The affiliated sites may have different privacy practices, and we encourage you to read their privacy policies.
  • Links - Graspr may present links in a format that enables us to keep track of whether these links have been followed. We use this information to improve the quality of our customized content and advertising.

How we use your Personal Information:
Graspr only processes personal information for the purposes described in this Privacy Policy and/or privacy notices that may be posted that are only relevant to the functionality offered by certain specific services. In addition to the above, such purposes include:

  • Operating, maintaining, and providing to you features and functionality of our products and services to users;
  • Ensuring the technical functioning of our network;  
  • Protecting your account from unauthorized access and verifying your authority to enter the Site;
  • Developing new services;
  • Using cookies, clear gifs, and log file information to: (a) store information so that you will not have to re-enter it during your visit or the next time you visit the Site; (b) provide custom, personalized content and information; (c) monitor the effectiveness of our marketing campaigns; (d) monitor aggregate metrics such as total number of visitors, pages viewed, etc.; and (e) track your entries, submissions, and status in promotions, sweepstakes, and contests; and
  • Improving the quality and design of the Site and services to create new features, promotions, functionality, and services by storing, tracking, and analyzing user preferences and trends.

 

We do not use your email address or other personally identifiable information to send commercial or marketing messages without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out. We may, however, use your email address without further consent for non-marketing or administrative purposes (such as notifying you of major Site changes or for customer service purposes).

Graspr processes personal information on our servers in the United States of America and in other countries. In some cases, we process personal information on a server outside your own country. We may process personal information to provide our own services. In some cases, we may process personal information on behalf of and according to the instructions of a third party, such as our advertising partners.
Information sharing
Graspr only shares personal information with other companies or individuals outside of Graspr in the following limited circumstances:

  • We provide such information to our subsidiaries, affiliated companies or other trusted businesses or persons for the purpose of processing personal information on our behalf. We require that these parties agree to process such information based on our instructions and in compliance with this Privacy Policy and any other appropriate confidentiality and security measures.
  • We will also disclose your personally identifiable information (a) only if we are required to do so by law, regulation or other government authority or otherwise in cooperation with an ongoing investigation of a governmental authority, (b) enforce the Graspr Terms of Service agreement, including investigation of potential violations thereof, (c) detect, prevent, or otherwise address fraud, security or technical issues, or (d) protect against imminent harm to the rights, property or safety of Graspr, its users or the public as required or permitted by law.
  • We may share with third parties certain pieces of aggregated, non-personal information, such as the number of users who searched for a particular term, for example, or how many users clicked on a particular advertisement. Such information does not identify you individually.

We will not sell your personally identifiable information to any company or organization except we may transfer your personally identifiable information to a successor entity upon a merger, consolidation or other corporate reorganization in which Graspr participates or to a purchaser or acquirer of all or substantially all of Graspr’s assets to which this Site relate.

Children's Privacy

Graspr recognizes the privacy interests of children and we encourage parents and guardians to take an active role in their children’s online activities and interests.  The Site is not intended for children under the age of 13.  Graspr does not target its services or this Site to children under 13.  Graspr does not knowingly collect personally identifiable information from children under the age of 13. 

Chat Rooms, Journals, WebLogs, Message Boards, Playback and Profile Pages, Videos and Public Forums
Any personal information or video content that you voluntarily disclose online (on discussion boards, in messages and chat areas, within your playback or profile pages, etc.) becomes publicly available and can be collected and used by others.
Your account name (not your email address) is displayed to other users when you upload videos or send messages through this Site and other users can contact you through messages and comments. Any videos that you submit to the Site may be redistributed through the Internet and other media channels, and may be viewed by the general public.

Invitations and Other Communications to Non-Members

Graspr users are encouraged to invite friends to join the Site and register for the services by sending e-mail invitations via an automated invitation system or other delivery method, online or offline.  Graspr stores the e-mail addresses or other user data that users provide so that the respondents may be added to the inviter’s list of friends on its personal page.  Graspr does not sell these e-mail addresses or other user information or use them to send any other communications other than invitations.  Invitees may contact Graspr to request the removal of their e-mail address from our database.
Information security
We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where we store personal data.
We restrict access to personal information to Graspr employees, contractors and agents who need to know that information in order to operate, develop or improve our services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.
Data integrity
Graspr processes personal information only for the purposes for which it was collected and in accordance with this Privacy Policy or any applicable service-specific privacy notice. We review our data collection, storage and processing practices to ensure that we only collect, store and process the personal information needed to provide or improve our services. We take reasonable steps to ensure that the personal information we process is accurate, complete, and current, but we depend on our users to update or correct their personal information whenever necessary.
Changes to this Privacy Policy
Graspr reserves the right to change the terms of this Privacy Policy at any time and will post notice of the updated Privacy Policy on the Site located at http://www.graspr.com/html/privacy.php so you are always aware of what personally identifiable information we may collect and how we may use this information. Graspr may also send registered users of the Site e-mail notifications notifying such users of any changes to the Privacy Policy.  Graspr encourages you to review this Privacy Policy regularly for any changes.  Your continued use of the Site and/or continued provision of personally identifiable information to use will be subject to the terms of then then-current Privacy Policy.

Correcting/Updating Personally Identifiable Information
Graspr provides you with the ability to review, correct and delete any of the personally identifiable information that you have provided to us in your user account and/or profile, but you should understand that this does not give you the ability to delete any content and/or material that you have posted to the Site, including, without limitation, blogs, videos, audio and/or pictures, that is posted in areas other than your user profile.  Once we have deleted or removed your user profile, you agree that Graspr shall not be responsible for any personally identifiable information that was not included within your deleted and/or removed user profile that remains on the Site.  If you wish to review or correct any information you have provided to us, you may access your account and review, correct and delete your personally identifiable information.
